South African Law Commission "Sentencing (A New Sentencing Framework). " Discussion Paper 91. Project 82. South African Law Commission

This is a background research paper for the Law Commissions project to develop a new sentencing framework. Some of the problems cited are cases are not treated a like, certain serious offences are not taken seriously enough, restorative justice measures are not being used for less serious offenses,and victims are not given enough of a role in the system. The research on restorative justice found significant sentiment favoring its use in less serious cases.
