Until recently in Austria, diversionary measures existed only in juvenile criminal law and in some limited areas of general criminal law, writes Marianne Löschnig-Gspandl. The situation changed, however, at the beginning of 2000 when, through an amending statute to the Austrian Code of Criminal Procedure, a comprehensive package of new diversionary measures came into force in general criminal law. Löschnig-Gspandl discusses the nature of diversion in Austria, available diversionary measures, restorative elements in those measures, the role of the public prosecutor, and legal prerequisites for diversion.
