Bria Huculak is a judge with the Provincial Court of Saskatchewan in Canada. She has work extensively in restorative justice at local, national, and international levels. She observes that, while restorative justice alternatives have been available in Canada for more than a decade, Canada still has a high rate of incarceration, especially for aboriginal people. The Youth Criminal Justice Act, which came into effect in April 2003, offers a new opportunity to revisit restorative justice principles and processes, asserts Huculak. With all of this in view, she discusses the Act and restorative justice, giving particular attention to aims and provisions of the legislation in relation to conferencing, circles, and rehabilitation and reintegration.
